These terms cover your use of phxhomebuyer.com and the cash-estimate form operated by PHXhomebuyer.com ("PHX Home Buyer," "we," "us"). By using the site or submitting the form, you agree to these terms. If you do not agree, don't use the form. You can still call us at (602) 320-9500.
What this site is
The site lets property owners in Phoenix, Arizona and the surrounding Valley ask for a cash estimate. It describes how a direct sale can work. It is not a listing agreement, not a commitment to buy your house, and not an offer.
No offer until a written agreement
Submitting the form does not obligate you to sell and does not obligate us to purchase. Any price discussed by phone, text, email, or on this site is a starting point. A purchase happens only if both sides sign a separate written agreement. We may decline any request.
Your information
You agree that you are authorized to inquire about the property and that the details you send are accurate to the best of your knowledge. Don't submit an address you have no right to discuss, and don't include someone else's contact information without permission. You must be at least 18 years old.
Contact by phone, text, and email
If you check the consent box, you agree that PHX Home Buyer may contact you at the phone number and email you provide about your request, including with automated technology, prerecorded or artificial voice messages, and texts. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of texts and HELP for help. No professional advice
Nothing on this site is legal, tax, financial, or real-estate brokerage advice. A cash sale can have tax and loan-payoff consequences. Talk with your own attorney, tax advisor, or lender before you sign anything.
Acceptable use
Don't misuse the site. That includes sending spam through the form, probing or disrupting the service, scraping it in a way that degrades it for others, or uploading malicious code. We may ignore or block submissions that look automated or incomplete.
Intellectual property
The site design, text, and graphics belong to PHXhomebuyer.com or its licensors. You may view them for your own property inquiry. You may not copy the site for another business or remove credit from materials we provide.
Third-party services
Address suggestions, if enabled, are provided by Google under its own terms. Hosting, data storage, and our customer relationship system are operated by vendors. We aren't responsible for a third party's outage or for the content of a site we link to, including the privacy and terms pages after you leave a form.
Disclaimers
The site is provided as-is. We don't warrant that it will be uninterrupted, that an estimate will be ready in a particular time, or that a sale will close in 14 days. A 14-day closing is a timeline we can offer when title, payoff, and both parties' schedules allow it. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent the law allows, PHXhomebuyer.com and its owners and agents are not liable for indirect, incidental, special, consequential, or lost-profit damages arising out of your use of the site or your reliance on an estimate. Our total liability for a claim about the site or the form will not exceed one hundred dollars. Some states do not allow these limits, so they may not apply to you.
Indemnity
You will defend and hold harmless PHXhomebuyer.com from claims, damages, and expenses, including reasonable attorney fees, that arise from information you submit or from your misuse of the site, except to the extent a claim is caused by our own willful misconduct.
Governing law
Arizona law governs these terms, without regard to conflict-of-law rules. Courts in Maricopa County, Arizona are the exclusive venue for a dispute about the site or these terms, unless the law requires otherwise. A purchase agreement you sign later may choose its own venue for that transaction.
Changes
We may update these terms by posting a new version on this page. The effective date will change with it. Continuing to use the site after an update means you accept the new terms. A form you already submitted stays covered by the terms posted when you sent it, plus any written agreement you sign later.
